So I demanded a refund. Then they said that they will resend it to me instead. I said ok and when will the item arrive. The seller didn't not reply up till this date January 22, And I replied December 26, I never recieved the item. And I didn't get a refund. The venue for suing a seller from China requires that you travel to their home town in China and serve the papers for a court date. That will give you a few months to make sure you have all the evidence together that is needed to prosecute them before the court date arrives.

During that time, hopefully you have enough money to support yourself. Then when you win the case you will hopefully get all the money back you paid for the scarf. It must have really been an expensive scarf. You could probably file a chargeback with your cc company. Apart from that, I hope you can step back and realize how absurd it is to talk of suing your seller.

First of all, because the US civil court system has no jurisdiction over a seller based in China. Even if you could bring legal action against him, the most you could do is take him to small claims court. We're talking about a scarf here. Do you know how much that cost? Court fees would set you back many times the price of this scarf, I'll bet. Of course. If your seller was in China then no, you can't sue him.
